Terms & Conditions for Customers
Before placing an order, if you have any queries relating to these terms and conditions, please email our customer service team at your nearest Oriflame branch https://lk.oriflame.com/customer-service) or/and the Consultant sourcing this Oriflame eCatalogue whose personal data are visible at the at the top right corner of the front page of this Oriflame eCatalogue. If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the User Agreement.
1. General Terms
1.1 The Oriflame eCatalogue (hereinafter “eCatalogue”) is an application allowing Customers to purchase Oriflame Products via internet.

1.3 The sales of the Oriflame Products, ordered using Oriflame eCatalogue are executed by the Consultant whose data are placed at the top, on the right side of the front page of the Oriflame eCatalogue.
1.4 For the purpose of these Terms & Conditions (hereinafter “T&C”) the following terms shall be understood as follows:
Consultant – the person legal or natural, sourcing eCatalogue directly from Oriflame website and sharing it by digital media (e-mail, blog, social media, website, etc.) with his/her Customers and who collects the orders of the Customers and delivers so ordered products in scope of its own activities; therefore the Consultant is the supplier of the Oriflame Products ordered using the Oriflame eCatalogue; Oriflame's Consultant are independent third party contractors and are not otherwise affiliated with Oriflame. Oriflame is not responsible or liable for the statements, acts or omissions of Oriflame's Consultant
Customer / Buyer – any person placing an order by the Oriflame eCatalogue especially acting for purposes outside its trade, business or profession;
Oriflame eCatalogue - the application which is an electronic version of printed Oriflame catalogue, including the current product offers and prices, which is displayed on certain website or social media account;
Oriflame Products - all the products in the Oriflame catalogue/offer, mainly cosmetics, accessories and dietary supplements,
Territory – means territory of Sri Lanka....
1.5 Oriflame is a trademark of Oriflame Cosmetics S.A. This mark may not be copied or used without Oriflame express written consent. Other brands and marks appearing on this website are the property of Oriflame Cosmetics S.A. or of other owners and require consent for their use.
2. Personal Data and Regulation
2.1 As a Customer, you will be asked to provide personal information such as, but not limited to, name and surname, address, telephone number, e-mail, etc. (hereinafter the “Personal Data”) which will allow Consultant to process your purchase order. If customer use the Website, he/she shall be responsible for maintaining the confidentiality of Name and Password. Customer agree that if they provide any information that is untrue, inaccurate, or incomplete or not in accordance with the this Terms and Conditions, Oriflame shall have the right to suspend or terminate or block access of user membership on the Website and refuse to provide user with access to the Website.
2.2 Personal Data is stored and administered by Oriflame (hereinafter the “Administrator”).
2.3 By submitting the purchase order, the Customer gives his/her consent to the storing and processing of Personal Data by Oriflame and the Consultant as well as the processing of the Personal Data by other entities for the purpose of: delivering the order placed by the Customer.
2.4 If the Customer gives an additional consent by ticking relevant box placed in Delivery Details, the Personal Data provided by the Customer, referred to in clause 2.1 above, will be processed in order to be informed of new Oriflame products, services, events and promotions by Oriflame or/and the Consultant. Customer is responsible to provide true, accurate, current and complete information about Personal data
2.5 The Customer's Personal Data is protected according to the binding regulations applicable to the state. The Administrator takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of the Personal Data. The Administrator restricts access to the Customer's Personal Data to employees who need to know that information in order to operate, develop or improve our services and to the Consultant as my be required by laws of the state..
2.6 Each Customer has the right to review, alter or request removal of the Personal Data by sending an e-mail to Customer Service at Oriflame ( https://lk.oriflame.com/customer-service )
2.7 The Personal Data may be provided to external suppliers of the services to the Administrator or the Consultant in order to process the Customers' orders. Only the information needed to perform their services will be disclosed to such suppliers. All suppliers are prohibited from using any information provided for other purposes than mentioned above and from sharing any Personal Data with anyone other than Consultant or Administrator.
2.8 The Consultant is authorized to process the Personal Data for the purpose of processing the orders placed by the Customer. The Consultant is obliged to protect Personal Data to the same extent as the Administrator and takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of Personal Data of the Customers.
2.9 The Customer is entitled to at anytime refuse receipts of commercial information; such refusal shall be sent to the e-mail address indicated in relevant commercial information received from Oriflame and/or Consultant.
3.1 All materials, including, but not limited to software or digital code, scripts, text, artworks, photographs, still or moving images, trademarks, trade names, video and audio (collectively "Materials" ) presented in eCatalogue are owned by Oriflame Cosmetics S.A.
3.2 It is prohibited to reproduce, copy, sell, resell and trade Oriflame eCatalogue and Materials.
3.3 It is prohibited to disrupt this service.
4. Purchasing rules
4.1 Before placing an order Customer is advised to check the product description carefully. By placing an order for a product, the Customer agrees to be bound by the conditions of sale included in the item's description. The Customer may place purchase orders for Oriflame Products in Oriflame eCatalogue by selecting the Oriflame Products. The placement of the order is considered as offer made by the Customer to buy the specified Oriflame Products.
4.2 Once the Oriflame Products are selected they are added to the shopping cart. The Customer may review and modify the content of the shopping cart by changing the quantity, deleting the Oriflame Products and removing the whole content of the shopping cart.
4.3 The orders can be placed 24h per day. The Oriflame eCatalogue may however, due to some technical reasons, not be accessible occasionally. Such case does not give grounds for any claims of any nature by the Customer or other visitor.
4.4 The order is placed when the following steps are completed by the Customer:
4.4.1 the Customer has logged in to the Oriflame eCatalogue and selected the Oriflame Products (s)he wishes to purchase by using the option “add to shopping cart”;
4.4.2 the Customer accepted the Terms and Conditions;
4.4.3 the Customer provided the necessary Personal Data allowing the delivery.
4.5 Neither Oriflame nor the Consultant shall take any responsibility for non delivery of the order or delayed delivery in case the Customer provided false or incorrect or incomplete delivery details.
4.6 Once the order is placed the confirmation box containing information that the order has been sent to the Consultant and the contact details of the Consultant shall be visible to the Customer,
4.7 The Consultant after receiving the information about placed order, contacts the Customer in order to agree the delivery method, place, time and costs as well as payment method. Shall these terms be not agreed between the Consultant and the Customer the order will be not approved. The Consultant may also reject the order placed by the Customer without stating a reason of such rejection.
4.8 After the delivery and payments terms are agreed between the Consultant and the Customer the Consultant approves the order and the Customer receives a confirmation e-mail contain summary of the order from the Consultant. The order will be confirmed by the Consultant by e-mail in the shortest possible time.
4.9 Shall the order be approved by the Consultant prior to agreeing with the Customer the payment and delivery terms and then there is no accord of the Parties as to these terms, the Customer may cancel its order by e-mail sent to the address indicated in the confirmation box as presented in cl. 4.6. and in the e-mail received pursuant to cl. 4.8.
4.10 The transaction is completed when:
4.10.1 the Customer has placed an order in Oriflame eCatalogue, and
4.10.2 the Consultant and the Consumer agreed the delivery option, delivery fees and payment method.
4.10.3 the order has been confirmed by the Consultant.
4.11 Availability of the products depends on level of stocks. In case of out of stock situation, the Customer is informed about it before the order is finalized, consequently the order may be altered or abandoned by the Customer. The Consultant is entitled to contact the Customer and suggest alternative products to those which are out of stock.
4.12 In case the part of the order cannot be delivered, the Consultant may propose to the Customer:
(a) cancelation of the whole order;
(b) cancelation of the order in part, in which the delivery is impossible within the prescribed period (if this option is selected by the Customer the order will be processed in part, the Consultant will be exempt from the obligation of delivery of the missing part of the order).
The Oriflame eCatalogue offer is equal to the Oriflame Catalogue offer and current promotions and it is binding during the period indicated on the eCatalogue front page.
6.1 The Prices of Oriflame Products displayed in Oriflame eCatalogue are equal to those in the Oriflame Catalogue. All prices are indicated in the local currency of the Territory and are inclusive of VAT (where applicable).
6.2 The prices of the Products may be changed over time at Oriflame's discretion without any notice.
6.3 The purchase price for the Customer is the price indicated on Oriflame eCatalogue at the moment the order is placed. The price is fixed.
6.4 The Prices of Oriflame Products do not include the costs of transport.
6.5 The Consultant shall inform the Customer about the transport and packaging fees. The transport and packaging fees depend on the delivery option offered by the Consultant. The delivery options are under discretion of the Consultant.
7.1 The ordered products can be delivered only in the Territory of Sri Lanka
7.2 The Delivery in person is possible only in a limited geographical area that is defined by the Consultant otherwise the order may delivered by post or other couriers at relevant delivery cost or it will be not confirmed and completed by the Consultant.
7.3 The approximate delivery time is indicated by the Consultant. Neither Oriflame nor the Consultant are liable for delays in delivery caused by circumstances beyond their control.
• Delivery of orders would be done at address specific not person/time specific.
• Oriflame or Oriflame's consultant are not responsible for non-delivery, unsatisfactory or delayed performance of services or damages or delays as a result of items which are out of stock, or otherwise unavailable.
• Customer agrees to provide authentic and true personal data. Oriflame reserves the right to confirm and validate the information and other details provided by the customer at any point of time. If the information's are found to be false, Oriflame shall in its sole discretion reject the registration
• In the event that a non-delivery occurs on account of a Wrong Name/Address given by customer all extra cost towards re-delivery shall be claimed from customer.
• Shipment/delivery time of order processing starts from the day of receipt of the payment confirmed against the order placed. In case of cash on delivery orders, the expected delivery time shall be calculated from the order. The Shipment /Delivery time is an approximate time Confirmed by Oriflame's Consultant against each product. Oriflame's Consultant shall not be liable for any delay / non-delivery of purchased goods by the Customer due to any force majeure event including but not limited to flood, fire, wars, acts of God or any event beyond their control
• Customer agrees not to purchase in bulk and resell the product. If it is found, Oriflame reserves all rights to cancel all future orders of the user account.
8. Returns/ Withdraw from the Agreement/Guarantee
8.1 The Customer being a natural person which, when purchasing Oriflame Products, is acting for purposes which are outside his trade, business or profession, may withdraw/ cancel the purchase within thirty days from the date of invoice without penalty and without giving any reason. The only charge that may be made to the Customer because of the exercise of his right of withdrawal / cancellation is the actual shipping charges ie. direct cost of returning the goods.
8.2 The withdrawal/ cancellation is effective if the Customer within a period of seven days informs the Consultant about the withdrawal and returns the products “sealed/ unopened” and in “not worsened condition” to the Consultant's address indicated in the e-mail received pursuant to cl. 4.8.
8.3. In case of the withdrawal/ cancellation, the amounts paid by the Customer will be reimbursed not later than 30 days from the moment of the withdrawal.
8.4. Oriflame provides a Unique Satisfaction Guarantee for Oriflame Products (hereinafter referred to “Satisfaction Guarantee”) which relates to all Oriflame Products in the Oriflame offer.
8.5 In case the Customer is not satisfied with any of the Oriflame Products, purchased from Oriflame eCatalogue (s)he may return them unopened/unused (in return for payment or exchange for another product) directly to the Consultant within 30 days from the date of invoice.
8.6 The Customer should check the content delivered to make sure that the consignment does not contain any damaged Products caused during transportation. The recipient of the consignment must describe the damage/defect in the protocol.
8.7 Any complaints concerning the Products quality received after the deadline specified in 8.5 will be handled by the Consultant in accordance to the applicable provisions of the law regarding the seller's / Consultant's liability to the consumer for the lack of conformity of the product with the contract of sale. If customer has any questions about product returns, replacement please contact Consultant directly
• Following reasons are eligible for replacement / return of Product
- Product was damaged
- Wrong item was sent by the Consultant .
In case the consultant doesn't have the product for replacement, Customer shall be obligated to accept the refund in lieu of replacement. All shipping and other replacement charges shall be borne and incurred by the Customer except shipping was damaged, product was defective or wrong product sent.
8.9 The following reasons are eligible for Refund
• The Customer did not receive the Delivery within the time period agreed in the Transaction
• Item was defective
• Item was damaged during the Shipping
• Products was / were missing
• Wrong item was sent by the Seller.
8.10 The following information will be required when returning your goods for Refund :
• Confirmation Email containing your Transaction Reference Number
• Delivery Documentation containing your Delivery Number
• List and description of goods to be returned
• Reason given for returning goods
In the event the Consultant accepts the return request raised by the Customer, Customer will have to return the product in sealed and unopened and in good condition and then the refund shall be credited to the Customer account by consultant.
8.11 Orders placed by the Customers with the Consultant using this eCatalogue facility and any understanding between the Consultant and the Customer with respect to such order placed, shall be sole responsibility of the Consultant and the same shall not bind Oriflame in any manner.
9. Changes to the Terms and Conditions
9.1. These T&C binds as of 15th October 2013
9.2 These T&C can be modified at any time.
9.3 The modified T&C will be published in Oriflame eCatalogue website and will be effective from the moment of publication to any orders placed after their publication. To the orders placed before such change, the previous version applies.
10.1 Oriflame and the Consultant is not responsible for blocking by administrators of mail servers transmitting the messages/notifications to the email address specified by the Customer and for removing and blocking emails by software installed on the computer used by the Customer.
10.2 The Customer may cancel receiving the Oriflame eCatalogue by sending cancelation request on the e-mail address of the Consultant.
10.3 In any matters not governed herein, the provisions of applicable laws in Sri Lanka shall apply.
10.4 Limitation Of Liabilities
In no event Oriflame Sri Lanka, its subsidiaries or affiliates or any of its employees, officers, members, managers, directors or representatives (the Oriflame entities) be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or for any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Oriflame website or services or for interrupted communications, delay, lost data or lost profits arising out of or in connection with these Terms and Conditions. Oriflame Sri Lanka is not liable for any claims against lack or deficiency of services; non-fulfillment or unsatisfactory fulfillment of products and services purchased by user from the Consultant. Oriflame shall not have any liability whatsoever for any aspect of the arrangements between the buyers of the site and Oriflame or the inability to use the products and services, procurement of substitute products , refunds and services under this eCatalogue facility.
